If originals are lost, certified copies can be obtained from the sub-registrar. However, bank lockers are not insurance, as RBI rules limit bank liability and exclude certain events, including floods.

If a fire broke out at home tonight, how long would it take the family to find the original sale deed, and would anyone other than the owner even know where to look?

For many Hyderabad homeowners, the honest answer is a little uncomfortable. The sale deed often rests in a plastic folder on a wardrobe shelf, while a few photos of it sit somewhere in an old WhatsApp chat. In other cases, the bank still holds the original papers, and the owner has only a vague memory of what the branch actually took.

This situation rarely feels urgent until something changes. A family might move house, close a home loan, face a water leak, or lose an elder who managed all the paperwork. Suddenly, a simple question about “where the papers are” turns into days of searching and worrying.

People in their 30s to 50s often feel this pressure most, because they handle the paperwork for their own home while also helping ageing parents with theirs. Fortunately, a clear and simple storage system solves most of the problem. This guide explains how such a system works, why each layer matters, and what options exist if an original goes missing.

ASBL Legacy - Coming up at RTC X ROADS

Be Among the First to Own a Legacy

2000 sq. ft at just ₹1.99 Cr ONWARDS

View Details

What Goes in the File (Not What Each Paper Means)

Before deciding where to store anything, it helps to know exactly what belongs in the file. A small fire, a slow leak from the bathroom wall, or even a well-meaning cleaner who does not recognise a sale deed can damage documents that are very hard to replace. For this reason, most families move their originals into a bank locker.

A locker works best when the owner adds a nominee, keeps a written list of its contents inside, and stores a copy of that same list at home. In addition, families often keep good photocopies at home for everyday use, so that the originals can stay in the locker even when a bank or society asks to see the papers.

However, a locker is not an insurance policy. The RBI’s revised locker instructions of August 2021 state that banks owe a duty of care, and they set out how far the bank’s liability goes.

Event

Bank’s liability under RBI rules

Fire, theft, burglary, robbery, dacoity, building collapse

Up to 100 times the annual locker rent

Fraud by a bank employee

Up to 100 times the annual locker rent

Flood, earthquake, lightning, thunderstorm

Not liable

Negligence by the customer alone

Not liable

A sample calculation: Consider a family that pays a sample locker rent of ₹4,000 a year. If a fire damages the locker, the bank’s maximum liability works out to ₹4,000 × 100, which equals ₹4 lakh. That amount may help, yet it bears no relation to the value of a flat worth, for example, ₹1.2 crore. In other words, the cap covers a failure by the bank, not the market value of the property or of the jewellery stored beside the deed. The real protection, therefore, comes from the public record at the sub-registrar and from good copies, which later sections explain.

One more small detail deserves attention. If only one person holds the locker key, and that person travels often, the family may struggle to reach the documents when they need them most. Sharing access thoughtfully, through a nominee or joint holder, avoids this gap.

If You Still Have a Home Loan, Ask Who Holds the Deed

Many homeowners do not hold their original sale deed at all, because their lender keeps it as security until the loan is fully repaid. This arrangement is completely normal. Even so, it works best when the owner knows exactly which papers the bank has taken.

The simplest way to achieve this is to request the document schedule in writing. This schedule lists every original the bank holds, and it becomes the checklist for the day the loan closes.

When the loan finally closes, a sensible approach is to collect every sheet against that list, ideally within the same week. Some owners wait months to visit the branch, and over time staff change, files move, and the trail becomes harder to follow. A deed that sits “somewhere in the branch” cannot really count as stored, whereas a deed that the owner has checked against a list and moved to a locker clearly can.

Loan stage

Who holds the original

What the owner keeps

Loan running

Lender

Written document schedule, full scan set

Loan closed

Owner (collected from lender)

Originals, foreclosure letter, scans

After collection

Bank locker with nominee

Locker list, photocopies, scans

Digital: Issued, Uploaded, and a Scan on Your Phone Are Three Things

Many people assume that any digital copy works as a backup. Nevertheless, banks and other offices still accept them unevenly, and many continue to ask for paper. A file that the owner uploads personally remains a scan, even when it sits inside DigiLocker.

Phone galleries and chat forwards create a different problem. A phone can break, get lost, or switch to a new number, and the photos may disappear with it. For this reason, families often keep a second copy of the full scan set in an encrypted drive or in a second trusted account. It also helps to keep the mobile number linked to DigiLocker up to date, because an old number can lock the owner out of their own records.

If the Original Is Lost

Losing an original sale deed feels alarming, yet the situation is usually recoverable. Under the Registration Act, 1908, a registered transfer becomes a public record at the sub-registrar’s office (SRO). As a result, the owner’s paper copy is only one copy of a record that already exists elsewhere.

The usual path is to apply for a certified copy of the registered deed through IGRS Telangana or directly at the sub-registrar’s office. A certified copy carries official weight, which makes it very different from a so-called “duplicate sale deed” printed at a shop, since such a printout has no legal standing.(Source)

In some cases, a lender or a future buyer may also want a police complaint, an intimation, or an affidavit along with the certified copy. Because these requirements vary, many owners speak with a lawyer before they approach a bank. The process does take time, which is exactly why the locker and the scan set exist: they let a family avoid this route altogether in most situations.

A List Someone Else Can Use

Even the best storage system fails if only one person understands it. Families sometimes discover a locker years after a parent has passed away, simply because nobody wrote down where it was.

A single page solves this problem quietly and well. The owner can keep one copy at home and another in the locker, and share the location with a trusted family member.

Item on the list

Example entry

Bank and branch

Name and address of the branch

Locker number

The number printed on the locker

Nominee

Name of the person registered as nominee

Key holder

Who keeps the key, and where the spare sits

Scan location

The encrypted drive or account that holds the scans

Loan account

Account number, if the bank still holds the originals

DigiLocker

The mobile number linked to the account

With this page in place, anyone in the family can find the documents calmly, even if the owner is travelling or unwell.

Do’s

Store originals in a bank locker with a nominee

Ask the lender for a written document schedule

Collect all originals soon after loan closure

Use DigiLocker Issued documents where available

Keep a full scan set in two separate places

Write a one-page list for the familyApply for a certified copy if an original is lost

Don’ts

Leave the only original on a wardrobe shelf

Assume the branch will return papers without a request

Wait months after foreclosure to visit the bank

Treat a self-uploaded scan as an issued original

Rely on WhatsApp photos as a backup

Keep locker details only in one person’s memory

Accept a shop-printed “duplicate sale deed”

Key Takeaways

Property documents stay safest in three layers: originals, issued digital copies, and a working scan set.

A bank locker with a nominee suits originals far better than a wardrobe.

RBI rules cap a bank’s locker liability at 100 times the annual rent and exclude floods and earthquakes.

On a running home loan, the lender often holds the deed, so a written document schedule matters.

DigiLocker Issued, DigiLocker Uploaded, and phone photos carry very different weight.

A lost deed can be recovered through a certified copy from the sub-registrar.

A one-page list helps the whole family find everything when it matters.

Frequently Asked Questions

<details class="wp-block-details is-layout-flow wp-block-details-is-layout-flow">
Where should the original sale deed be kept?

Most owners keep it in a bank locker with a nominee, or with their home-loan lender until the loan closes, against a written list of documents.
