For home buyers, the key is to verify the ownership documents, the flat’s share, the seller’s authority, and RERA details before booking. A JDA is common in Hyderabad, but the paperwork still needs careful scrutiny.

Imagine a relationship manager smiling across the table and saying, “This is a JDA project.” Should the buyer feel reassured, worried, or simply confused?

For many Hyderabad home-buyers, the honest answer is confused. The phrase sounds technical, and it raises quiet questions almost immediately. Who actually owns the land under the tower? Could the landowner block the sale deed later? What happens if the developer and the owner stop getting along halfway through construction?

Fortunately, these questions have clear answers. Joint development is one of the most common ways that gated communities in Hyderabad get built, largely because land often belongs to families while building skills belong to developers. As a result, a JDA is a normal structure rather than a warning sign.

Still, a normal structure deserves a careful reading. Buyers in their 30s to 50s usually commit a large part of their savings to one home, so understanding the paperwork behind it makes good sense. This guide explains what a JDA is, which documents matter, whose share a flat belongs to, how RERA applies, and what a sensible booking checklist looks like.

ASBL SPECTRA

ASBL SPECTRA - Luxury 3BHK in Financial District

Live Where You Work | Spacious 3 BHKs in the Heart of the Financial District| Ready to move-in | From ₹1.99 Cr .

View Details

View More ➝

What a Joint Development Agreement Actually Is

At its simplest, a joint development agreement brings two parties together. One side contributes land, and the other side contributes approvals, money, and construction. Once the project is complete, both sides share the result according to the terms they agreed on.

Generally, that sharing follows one of two models.

Model

How it works

Sample example

Area sharing

The finished flats are divided between the landowner and the developer on the sanctioned plan

In a 200-flat project with a 40:60 split, the landowner receives 80 flats and the developer receives 120

Revenue sharing

The developer sells the flats, and the sale money is divided by an agreed percentage

If total sales reach ₹100 crore and the owner’s share is 35%, the owner receives ₹35 crore

Here is the key point for a home-buyer. The JDA is a contract between the landowner and the developer, so it governs their relationship with each other. By contrast, the buyer’s relationship rests on a different set of papers, namely the allotment letter, the registered agreement for sale, and finally the sale deed. ASBL’s guide to the allotment letter, agreement to sell, and sale deed explains that chain in detail.

In short, the JDA belongs to the landowner and the developer, whereas the sale deed belongs to the buyer. Ideally, both documents appear on the encumbrance certificate.

The Papers: JDA, DA-cum-GPA, and Your Sale Deed Are Different

Several documents with similar names appear in a JDA project, and they are easy to mix up. Each one, however, does a different job and carries a different stamp duty. The table below draws on the IGRS Telangana ready reckoner.

Instrument

What it does

Stamp duty

Registration fee

Development agreement

Records the deal between the landowner and the developer

0.5%, not adjustable

0.5%, minimum ₹5,000, maximum ₹50,000

Development agreement-cum-GPA

Records the deal and also gives the developer a general power of attorney over the land for the project

1%, not adjustable

0.5%, minimum ₹5,000, maximum ₹1,00,000

Agreement of sale-cum-GPA

A near-transfer of property, close to a sale

6.5% (5.5% adjustable)

As per IGRS

Sale deed

Transfers one flat to the buyer

As per IGRS for the area

As per IGRS for the area

For both development agreements, IGRS calculates stamp duty on the higher of two values: the land value or the estimated construction cost.

A sample calculation: Suppose the chargeable value of a project works out to ₹20 crore. In that case, a plain development agreement attracts 0.5% stamp duty, or ₹10 lakh, while its registration fee reaches the ₹50,000 cap. Meanwhile, a development agreement-cum-GPA on the same value attracts 1% stamp duty, or ₹20 lakh, with a registration fee capped at ₹1,00,000. An agreement of sale-cum-GPA, on the other hand, would cost ₹1.3 crore at 6.5%, which shows just how different these instruments are.(Source)

The GPA deserves particular attention. Through it, the developer gains the right to deal with the land for the project, including signing documents and selling units. A careful buyer therefore prefers a registered GPA that, ideally, limits the developer’s selling rights to the developer’s own share. For details on the 6.5% sale-cum-GPA, ASBL’s guide to stamp duty in Telangana covers it separately.

Whose Flat Are You Buying: Developer Share or Landowner Share?

Within a single tower, flats can belong to two different sellers. Under an area-sharing JDA, the sanctioned plan marks some units as the developer’s share and others as the landowner’s share. Consequently, two buyers living on the same floor may have bought from two different people.

Developer share

Landowner share

Who usually sells

The developer, as promoter

The landowner, or a person to whom the owner allotted the unit

Who signs the sale deed

The developer, with the landowner sometimes joining

The landowner, sometimes with the developer joining

What the buyer confirms

The unit appears in the developer’s share on the plan

The unit appears in the owner’s share, and RERA and the lender accept this seller

Both paths can work well. Even so, the buyer benefits from asking three simple questions. Which share does this specific unit belong to? Who will sign the sale deed? Will the home-loan lender accept that seller?

Banks pay close attention to these answers, since they want a clean seller on the deed before releasing a loan. Additionally, a flat from the landowner’s share sometimes comes at a lower price. A lower price, however, does not automatically mean a safer purchase, so the same checks apply in both cases.

What RERA Does (and What the July 2026 Ruling Means for You)

Under the RERA Act, 2016, a person who pays for a flat as a buyer counts as an allottee. That status remains the same whether the project runs under a JDA or not. Moreover, when the developer does not own the land, the Telangana RERA Rules require the promoter to file the landowner’s consent and a copy of the JDA at registration.

Recently, the Telangana RERA authority added a useful clarification. In complaint 579/2025, as reported by Hyderabad Mail on 24 July 2026, the authority held that landowners who contributed land under a development agreement-cum-GPA and received a built-up share are co-promoters rather than allottees. In practical terms, such landowners cannot approach RERA as though they were home buyers.

For a buyer, the meaning is simple. The ruling concerns landowners, not purchasers. A person who paid for a flat remains an allottee and keeps the protection that RERA offers to buyers.

On the TGRERA portal, a buyer can therefore check a few things:

The list of promoters, including any landowners named as co-promoters

Whether the JDA has been uploaded

Whether the land carries a mortgage

The declared project timelines

ASBL’s TS-RERA guide for beginners explains how to use the portal, while the guide on how to verify a builder’s RERA track record covers the developer’s history.

What Can Go Wrong for a Buyer

Most JDA projects run smoothly. Also worth noting is that any capital-gains tax the landowner owes on the JDA is the owner’s matter and does not decide the buyer’s title.

A Booking Checklist

Before paying a booking amount in a JDA project, a buyer can work through this short list:

Confirm that the JDA or development agreement-cum-GPA is registered and appears on the encumbrance certificate.

Check TGRERA for the list of promoters and the uploaded JDA.

Obtain the share split in writing, showing which units belong to the developer and which belong to the landowner.

Identify the seller of the chosen unit and the person who will sign the sale deed.

Ask whether the land or the unit carries a mortgage, and request the release letter where relevant.

Review the sanctioned plan and the expected occupancy certificate timeline.

Ask a property lawyer to read the JDA extract, regardless of how polished the brochure looks.

Once these points check out, the buyer can move ahead with far greater clarity. Problems usually come from an unregistered or incomplete paper trail, a GPA that is too broad, a mortgage on the whole land, or a dispute between the owner and the builder. When the JDA is registered, disclosed on TGRERA, and backed by a clear share split and the right seller on the deed, the project follows a well-established pattern.

</details>

<details class="wp-block-details is-layout-flow wp-block-details-is-layout-flow">
Is a development agreement-cum-GPA the same as an agreement of sale-cum-GPA?

No, the IGRS ready reckoner lists them as separate instruments. A development agreement-cum-GPA carries 1% stamp duty, which is not adjustable, on the higher of the land value or the estimated construction cost. In contrast, an agreement of sale-cum-GPA is a near-transfer document stamped at 6.5%.

</details>

<details class="wp-block-details is-layout-flow wp-block-details-is-layout-flow">
Can a buyer purchase a flat from the landowner’s share?

Yes, in many projects the landowner sells units from their own share. A buyer who pays for such a unit can still be an allottee. Even so, it helps to confirm the seller’s identity, check that the unit appears in the owner’s share on the plan, and make sure that RERA and the lender accept the seller.

</details>

<details class="wp-block-details is-layout-flow wp-block-details-is-layout-flow">
Does RERA protect a buyer in a JDA project?

Yes. A person who buys a flat counts as an allottee under RERA.
